Privacy Policy

What Backup Logistics LLC collects when you contact us or run freight with us, what we do with it, and how mobile numbers and SMS consent are handled.

1. Information We Collect

Backup Logistics LLC collects the following personal information when you interact with our website, contact forms, or services:

  • Full name and business name
  • Email address
  • Mobile phone number
  • Company address and location
  • Freight and shipment details you provide
  • Communication records (calls, texts, emails)

Carriers who complete our onboarding form also provide operating authority numbers (MC and DOT), an EIN, insurance details, and an electronic signature on the dispatch agreement. When you submit any form on this site we also record the IP address and browser the submission came from, and the date and time, so that a signature or a consent can be shown to be genuine later.

2. How We Use Your Information

We use your information solely to provide freight logistics and transportation services, including:

  • Dispatching and coordinating freight shipments
  • Sending load confirmations, rate confirmations, and operational updates
  • Communicating via SMS, phone, or email for dispatch purposes
  • Processing payments and managing business accounts
  • Complying with legal and regulatory obligations

We do not use your information to build advertising profiles, and we do not use it for any purpose you would not expect from a freight dispatch company you have contacted.

3. SMS / Text Message Communications

If you provide your mobile phone number, you may receive SMS text messages from Backup Logistics LLC related to your freight operations. These messages are strictly operational and informational in nature.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. No mobile opt-in or text message consent will be shared with third parties or affiliates.

You can opt out of SMS messages at any time by replying STOP to any message. Reply HELP for support. Message and data rates may apply. Messaging frequency varies based on active operations. Wireless carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is never a condition of purchase or of using our services. When you tick an SMS consent box on this site we record the exact wording you were shown, along with the date, time, IP address and browser, so that we can show what you agreed to and so that you can ask us for that record.

4. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties. Your information may be shared only in the following limited circumstances:

  • Service providers. The telecommunications and messaging providers who deliver our text messages and email on our behalf, and the hosting and database providers that run this website. They may use your information only to perform that service for us, and are bound by confidentiality obligations.
  • Freight partners. Carriers, shippers, brokers and facilities directly involved in coordinating a load you are part of, and only the details needed to move that load.
  • Legal compliance. When required by law, subpoena, court order, or a government or regulatory authority including the FMCSA, or to establish or defend a legal claim.
  • Business transfers. If Backup Logistics LLC is involved in a merger, acquisition, financing, reorganization or sale of assets, your information may be transferred as part of that transaction. The receiving party stays bound by this policy for information collected under it, and we would tell you before your information became subject to a different policy.

We do not share your mobile opt-in data or SMS consent information with any third party or affiliate for marketing purposes. Mobile information is not shared with third parties or affiliates for marketing or promotional purposes, and it is not sold under any circumstances, including as part of a business transfer.

5. We Do Not Sell Your Information

We have never sold personal information and we do not sell it. We do not share it for cross-context behavioural advertising, we do not trade or rent contact lists, and we do not supply your details to lead-generation companies, data brokers or marketing partners.

This applies without exception to mobile phone numbers, mobile opt-in data and SMS consent records.

6. Cookies, Analytics and Tracking

This website does not use cookies. It runs no advertising pixels, no third-party analytics, no session recording and no cross-site tracking of any kind. Nothing here follows you to another site, and there is no consent banner because there is nothing to consent to.

Two things are stored by your own browser, on your own device, and neither is ever sent to us:

  • Your light or dark theme choice, so the site looks the way you left it.
  • A draft of the carrier onboarding form, held only until you close the tab, so that a refresh does not lose four steps of typing. Your drawn signature and your agreement acknowledgements are deliberately never stored this way.
  • A sign-in token for our internal console, and only if you are Backup Logistics staff who has signed in to it. A visitor never receives one.

You can clear all of these at any time through your browser's settings for this site, and the site will keep working.

One third party does see a request from your browser: this site loads its typefaces from Google Fonts, so Google receives the IP address that asks for the font files. It receives nothing else about you, and nothing you type on this site.

7. Data Security

We take reasonable technical and organizational measures to protect your personal information from unauthorized access, loss, or disclosure. This site is served over HTTPS, form submissions are encrypted in transit, and access to submitted records is limited to Backup Logistics staff who need it and protected by individual accounts.

However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

8. How Long We Keep Your Information

We keep personal information only as long as we have a reason to, and different records have different reasons:

  • Contact, quote and inquiry submissions. Kept while we are working on the request, and afterwards as ordinary business records. Ask us and we will delete them.
  • Carrier files, signed dispatch agreements, rate confirmations and settlement records. Kept for at least three years after the transaction, because federal regulations covering licensed brokers require a record of each transaction to be retained for that period, and longer where tax or insurance rules require it.
  • SMS consent and opt-out records. Kept for as long as we may need to show that a message was authorized. After an opt-out we keep a minimal record of the number and the fact that it opted out. That record exists precisely so that we do not text you again, and it is used for nothing else.

When a record is no longer needed for any of these reasons, it is deleted.

9. Your Rights and Choices

You have the right to:

  • Opt out of SMS at any time by replying STOP to any message, or by emailing us with the number. There is no penalty, and it does not affect your loads, your settlements, or anything else about working with us.
  • Access the personal information we hold about you, including the SMS consent record: what you were shown, and when you agreed to it.
  • Correct anything that is wrong or out of date.
  • Delete your information. We will delete what we are able to, and tell you plainly which records we are legally required to keep and for how long, rather than quietly keeping them.
  • Opt out of email, or ask us to reach you only by phone.
  • Ask a question about anything in this policy and get a real answer from a person.

10. State Privacy Rights

Backup Logistics LLC operates from Texas and New Jersey, and both states have consumer data privacy laws. Depending on where you live, you may have statutory rights to know what personal data we process, to obtain a copy of it, to correct it, to have it deleted, and to opt out of its sale or of targeted advertising.

We give every person who contacts us all of those rights regardless of which state they are in, because that is simpler and fairer than working out who qualifies. The opt-out rights for sale and for targeted advertising are moot here: as section 5 says, we do neither.

To exercise any of these rights, or to appeal a decision we make about a request, email hr@backuplogistics.us. If we deny a request we will tell you why, and how to appeal it.

11. Children's Privacy

This is a commercial freight service. It is not directed at children, we do not knowingly collect personal information from anyone under 18, and our Terms and Conditions require users to be at least 18. If you believe a minor has given us personal information, email hr@backuplogistics.us and we will delete it.

12. Changes to This Policy

We may update this Privacy Policy. When we do, the revised policy is posted on this page with a new "last updated" date, and material changes are described rather than slipped in. Continuing to use our website or services after a change means you accept the updated policy.

A change to this policy never retroactively removes a consent record or an opt-out. If we ever wanted to use information in a way this policy does not allow, we would ask you first.
